New Jersey's top prosecutor leaves her post in the wake of judicial deems ineligible her.
The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This follows a court battle that questioned her eligibility to occupy the role.
Attorney General's Statement
US Attorney General, Pam Bondi, announced the prosecutor's departure on the start of the week. Bondi stated that the court's "flawed" ruling made it "untenable" for the official to perform her duties.
"Let no one confuse adherence to the ruling as defeat," Habba stated. "My fight will now stretch across the country."
Judicial Challenge
Her resignation follows closely on a federal appellate panel determined that she had been unlawfully serving as the federal prosecutor. This decision is expected to impact scores of legal proceedings in New Jersey.
The court declared that a interim role that did not receive Senate approval breached the statute on vacant positions.
Ongoing Legal Battle
It was also stated that she will stay on at the Department of Justice as a high-level advisor. She will challenge the decision of the court's action, aiming for a overturned decision.
On a social media platform, the Attorney General contended that the judiciary "should not be able to second-guess the President's choice of lawyers entrusted with executing the executive branch's core responsibility of criminal prosecution."
Performance in Office
The attorney general highlighted Habba's record and noted that while she was in charge, the state capital of Newark saw a significant drop in offenses. She also stated that the Camden experienced its initial homicide-free summer since 1974 free from homicides.
Connection to Donald Trump
Habba, 41, first joined Donald Trump's lawyers in 2021. Subsequently, she acted for Trump in his hush-money trial in 2024, which resulted in his guilty verdict on dozens of charges of document fraud.
Prior to assuming the top New Jersey post, the former president had announced he was selecting her as his presidential counsellor if re-elected, labeling Habba as "unwavering in her loyalty" and a dedicated fighter for justice.
